Atlas Terms of Service

These Terms of Service (“Terms”) govern your use of the Atlas mobile application (“Atlas: Bilgi Yarışması & Quiz”, the “App”) published by Forcell (“Forcell”, “we”). By downloading, installing or using the App you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old to use the App. By using it you confirm that you meet this requirement and that you are legally able to enter into these Terms.

2. Licence

Forcell grants you a limited, non-exclusive, non-transferable, revocable licence to install and use the App on devices you own or control, for personal, non-commercial purposes, in accordance with these Terms and the rules of the store you downloaded it from.

You may not:

copy, modify, reverse-engineer, decompile or create derivative works of the App;
circumvent security, licensing or purchase checks;
use the App for any unlawful purpose or in violation of these Terms.

3. Accounts and Conduct

Provide accurate information and keep your device and credentials secure; you are responsible for activity under your account.
Do not impersonate others, use offensive names or infringe anyone’s rights.
Do not interfere with the App, its servers or other users.

4. Purchases and Subscriptions

Purchases are made through Apple App Store or Google Play and are subject to their terms. Prices are shown in the store before you confirm.
Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. Manage or cancel them in your store account settings.
Free trials, where offered, convert to a paid subscription at the end of the trial unless cancelled.
Refunds are handled by the store under its policies; we cannot issue refunds directly.

5. Intellectual Property

The App, including its code, design, illustrations, animations, text and trademarks, is owned by Forcell or its licensors and protected by copyright and other laws. Except for the licence above, no rights are granted.

6. Termination

You may stop using the App at any time by uninstalling it. We may suspend or terminate access if you breach these Terms. Sections that by their nature should survive (intellectual property, disclaimers, limitation of liability, governing law) survive termination.

7. Disclaimer and Limitation of Liability

To the maximum extent permitted by law, the App is provided “as is” and “as available” without warranties of any kind, express or implied. Forcell does not warrant that the App will be uninterrupted, error-free or meet your requirements.

To the maximum extent permitted by law, Forcell and its officers, employees and agents are not liable for any indirect, incidental, special, consequential or punitive damages arising out of your use of or inability to use the App. Our total liability for any claim is limited to the amount you paid for the App in the twelve months before the claim.

8. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-law rules. The courts and enforcement offices of Istanbul (Çağlayan) have exclusive jurisdiction, without prejudice to mandatory consumer-protection rules in your country of residence.

9. Changes

We may update these Terms. The effective date and version at the top identify the current revision; continued use after a change means you accept the updated Terms.

Bu Kullanım Koşulları (“Koşullar”), Forcell (“Forcell”, “biz”) tarafından yayımlanan Atlas mobil uygulamasının (“Atlas: Bilgi Yarışması & Quiz”, “Uygulama”) kullanımını düzenler. Uygulamayı indirerek, yükleyerek veya kullanarak bu Koşulları ve Gizlilik Politikamızı kabul etmiş olursunuz. Kabul etmiyorsanız Uygulamayı kullanmayın.

1. Kullanım Şartları ve Yaş Sınırı

Uygulamayı kullanmak için en az 13 yaşında olmalısınız. Uygulamayı kullanarak bu şartı karşıladığınızı ve bu Koşulları kabul etmeye hukuken ehil olduğunuzu beyan edersiniz.

2. Lisans

Forcell size, bu Koşullara ve indirdiğiniz mağazanın kurallarına uygun olarak, sahibi olduğunuz veya kontrol ettiğiniz cihazlarda kişisel ve ticari olmayan amaçlarla Uygulamayı yükleme ve kullanma konusunda sınırlı, münhasır olmayan, devredilemez ve geri alınabilir bir lisans verir.

Şunları yapamazsınız:

Uygulamayı kopyalamak, değiştirmek, tersine mühendislik yapmak, kaynak koda dönüştürmek veya türev çalışmalar oluşturmak;
güvenlik, lisans veya satın alma kontrollerini atlatmak;
Uygulamayı hukuka aykırı bir amaçla veya bu Koşulları ihlal edecek şekilde kullanmak.

3. Hesaplar ve Davranış Kuralları

Doğru bilgi verin; cihazınızı ve giriş bilgilerinizi güvende tutun. Hesabınız altındaki etkinlikten siz sorumlusunuz.
Başkalarını taklit etmeyin, saldırgan adlar kullanmayın, kimsenin haklarını ihlal etmeyin.
Uygulamaya, sunucularına veya diğer kullanıcılara müdahale etmeyin.

4. Satın Almalar ve Abonelikler

Satın almalar Apple App Store veya Google Play üzerinden yapılır ve onların koşullarına tabidir. Fiyatlar onaylamadan önce mağazada gösterilir.
Abonelikler, geçerli dönemin bitiminden en az 24 saat önce iptal edilmedikçe otomatik yenilenir. Mağaza hesabı ayarlarınızdan yönetebilir veya iptal edebilirsiniz.
Sunulduğu durumlarda ücretsiz denemeler, iptal edilmedikçe deneme sonunda ücretli aboneliğe dönüşür.
İadeler mağaza tarafından kendi politikalarına göre yürütülür; doğrudan iade yapamayız.

5. Fikri Mülkiyet

Uygulama; kodu, tasarımı, çizimleri, animasyonları, metinleri ve markaları dâhil olmak üzere Forcell’e veya lisans verenlerine aittir ve telif hakkı ile diğer yasalarla korunur. Yukarıdaki lisans dışında hiçbir hak verilmez.

6. Fesih

Uygulamayı kaldırarak kullanımı istediğiniz zaman sonlandırabilirsiniz. Bu Koşulları ihlal etmeniz hâlinde erişimi askıya alabilir veya sonlandırabiliriz. Niteliği gereği devam etmesi gereken bölümler (fikri mülkiyet, sorumluluk reddi, sorumluluğun sınırlandırılması, uygulanacak hukuk) fesihten sonra da yürürlükte kalır.

7. Sorumluluk Reddi ve Sorumluluğun Sınırlandırılması

Yasaların izin verdiği azami ölçüde Uygulama, açık veya zımni hiçbir garanti olmaksızın “olduğu gibi” ve “mevcut olduğu şekliyle” sunulur. Forcell, Uygulamanın kesintisiz, hatasız olacağını veya gereksinimlerinizi karşılayacağını garanti etmez.

Yasaların izin verdiği azami ölçüde Forcell ile yöneticileri, çalışanları ve temsilcileri; Uygulamayı kullanmanızdan veya kullanamamanızdan kaynaklanan dolaylı, arızi, özel, sonuç olarak ortaya çıkan veya cezai hiçbir zarardan sorumlu değildir. Herhangi bir talep için toplam sorumluluğumuz, talepten önceki on iki ayda Uygulama için ödediğiniz tutarla sınırlıdır.

8. Uygulanacak Hukuk ve Uyuşmazlıklar

Bu Koşullar, kanunlar ihtilafı kuralları dikkate alınmaksızın Türkiye Cumhuriyeti hukukuna tabidir. Uyuşmazlıklarda İstanbul (Çağlayan) mahkemeleri ve icra daireleri yetkilidir; ikamet ettiğiniz ülkedeki emredici tüketici koruma hükümleri saklıdır.

9. Değişiklikler

Bu Koşulları güncelleyebiliriz. Üstteki yürürlük tarihi ve sürüm güncel revizyonu gösterir; değişiklikten sonra kullanıma devam etmeniz güncel Koşulları kabul ettiğiniz anlamına gelir.
