Terms of Service & Medical Disclaimer

1. Acceptance of Terms

By downloading, accessing, or using the Koza: Pregnancy & Baby Tracker mobile application ("Koza" or "Application"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree with any part of these Terms, you must immediately cease using the Application and uninstall it from your device.

2. Explicit Consent for Health Data Processing

By creating a profile and entering personal reproductive parameters (such as Last Menstrual Period, Estimated Due Date, contraction logs, water intake, maternal weight, medication/vitamin schedules, and personal medical visit notes), you provide your explicit, informed, and voluntary consent to Forcell to process these sensitive health data points locally on your device and through our encrypted infrastructure solely for generating your personalized pregnancy timeline. You may withdraw your consent at any time by wiping your data in Profile ➔ Verileri Sil ve Sıfırla.

3. Permitted Use & User Accounts

Koza is intended for personal, non-commercial use by expectant parents and their designated supporters (such as partners or relatives). When using Koza, you agree to:

• Provide accurate, truthful information and maintain the confidentiality of your device and login credentials,
• Choose respectful community forum usernames that do not impersonate medical professionals, violate intellectual property, or use offensive language,
• Use the Application in full compliance with all applicable local, national, and international laws.

4. Community Forum Code of Conduct

Koza provides a supportive peer community forum for mothers and parents. Users participating in forum discussions must strictly adhere to the following rules:

• No Medical Prescriptions: Users must not prescribe pharmaceuticals, offer definitive clinical diagnoses, or advise against professional medical treatments.
• Zero Tolerance for Abuse: Harassment, hate speech, bullying, defamation, discriminatory remarks, or sexually explicit material will result in immediate content removal and permanent ban.
• No Commercial Spam: Unsolicited advertisements, affiliate links, or commercial promotions are strictly forbidden.

5. Intellectual Property Rights

All copyrights, trademarks, 3D anatomical models, visual assets, illustrations, animations, user interface designs, and educational content contained in Koza are the exclusive property of Forcell or its licensors. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Application for personal, non-commercial purposes.

6. Limitation of Liability & Warranty Disclaimer

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APPLICATION IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

IN NO EVENT SHALL FORCELL, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO HEALTH COMPLICATIONS, PERSONAL INJURY, LOSS OF DATA, OR MEDICAL EXPENSES ARISING OUT OF YOUR USE OR INABILITY TO USE THE APPLICATION OR RELIANCE ON ANY INFORMATIONAL CONTENT PROVIDED THEREIN.

7. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without giving effect to any conflict of law principles. Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the Courts and Execution Offices of Istanbul (Central).
